Heard learned counsel for the parties.

The Petitioner is an accused in Jagannath Prasad P.S. Case No. 114 of 2020 corresponding to G.R. Case No.608 of 2020 on the file of learned S.D.J.M., Bhanjanagar, under Sections 302/307/34 I.P.C., and is in custody since 26.06.2020. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Addl. Sessions Judge, Bhanjanagar by order dated 10.11.2020, the present BLAPL has been filed.

Learned counsel for the Petitioner places reliance on the order of this Court dated 25.10.2021 passed in BLAPL No. 3328 of 2021 and submits that the Petitioner is similarly circumstanced with the Petitioner in the said case (Kuna Sethi).

Learned counsel for the State while not disputing such submission states that there are other attending circumstances for which the present Petitioner is not entitled to any relief. 7.

On a conspectus of materials on record and considering the order passed by this Court in the case of co-accused referred to above, this Court directs that the Petitioner to be released on bail on such terms to be fixed by the Court in seisin of the matter. 7.

Accordingly, the BLAPL is disposed of.
