This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

The Petitioner has filed this writ petition seeking to quash the order dated 22.03.2022 under Annexure-1 passed by the Regional Provident Fund Commissioner, Keonjhar under Section 7-A of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952, directing to pay an amount of Rs.18,62,568/- for the period from 11/2018 to 11/2019.

Mr.B.P.Panda, learned counsel for the Petitioner fairly contended that that against the order dated 22.03.2022 passed by the Regional Provident Fund Commissioner, Keonjhar in Diary No.25/20 appeal lies and, as such the Petitioner though preferred appeal bearing Appeal Case No.08 of 2022 before the CGIT-cum-Labour Court, Bhubaneswar-cum-Designated Appellate Authority, but due to non-functioning of the same, the Petitioner has approached this Court by filing the present writ petition.

In such view of the matter, this writ petition stands disposed of directing the Opposite Parties not to take any coercive action against the Petitioner pending adjudication of the appeal preferred by the Petitioner before the CGIT-cum-Labour Court, Bhubaneswar-cumDesignated Appellate Authority. 5.

Issue urgent certified copy as per Rules.
