Abhaya Behera v. State
IN THE HIGH COURT OF ORISSA AT CUTTACK
CRLMC No.3718 of 2012 Abhaya Behera and others ....
Petitioners versusState of Orissa and another ....
Opposite Parties CORAM: JUSTICE S. PUJAHARI Order No.
ORDER
28.03.2022 07.
1.
This matter is taken up through hybrid mode.
2.
This application under Section 482 of Cr.P.C. has been filed by the Petitioners with a prayer to quash the F.I.R. in Banpur P.S. Case No.175 of 2012, corresponding to G.R. Case No.281 of 2012, pending in the Court of J.M.F.C., Banpur in terms of the compromise between the parties.
3.
Heard the learned counsel for the Petitioners and the learned counsel for the State-Opposite Party No.1. No one appears on behalf of the Opposite Party No.2.
4.
Since the F.I.R. allegation reveals prima facie a cognizable case, this Court is not inclined to quash the aforesaid F.I.R. 5.
But giving liberty to the Petitioner to file joint petition for quashment of the F.I.R., if so advised, this petition stands dismissed. (S. Pujahari) Judge DA
