Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. 3.

The petitioner is an accused in connection with Bolangir Town P.S. Case No. 622 of 2021 corresponding to G.R. Case No. 1744 of 2021, pending on the file of the learned SDJM, Bolangir for commission of the alleged offence under Sections 302/34 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Sessions Judge, Balangir by order dated 05.05.2022, the present BLAPL has been filed. 5.

Learned counsel for the petitioner submits that there are no materials implicating the petitioner and it is based on substantial evidence and chain of circumstances is not complete so

as to implicate the petitioner. It is further submitted that taking into account the age of the petitioner that in the meanwhile the Charge-sheet has already been filed and the case has been committed, his further continuance is not warranted. 6.

Learned counsel for the State relying on the statement of the informant the father of the victim who identified the petitioner from CCTV footage opposes the prayer for bail. 7.

Perused the statement of Somanath Mishra who produced the CCTV footage along with necessary certification and that of the informant.

Taking into account the materials on record, this Court is not inclined to entertain this bail application at this stage. 9.

Accordingly, the BLAPL stands rejected.
