Heard Mr. S.P. Mishra, learned counsel for the petitioner and Mr. A.R. Dash, learned Additional Government Advocate. 2.

According to Mr. S.P. Mishra, the petitioner is aggrieved by the quantum of compensation that has been awarded to him in connection with the land acquisition proceeding undertaken under Coal Bearing Areas (Acquisition & Development) Act, 1957. He further submits that the quantum should be redetermined and the matter shall be referred to the Tribunal constituted under the above noted Act.

During course of hearing, Mr. S.P. Mishra submits that liberty may be granted to the petitioner to approach the Chairman-cum-Managing Director of Mahanadi Coalfields Limited (opposite party No.1) by filing a representation and the said opposite party be directed to take a decision on such motion within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file a representation before the Chairmancum-Managing Director of Mahanadi Coalfield Limited (opposite party No.1) through registered post within a period of two weeks from today. In the event, such a representation is filed along with a copy of this order, the opposite party No.1 is directed to take a decision on the same in accordance with law within a period of four weeks from the date of receipt of such representation and communicate the result of such exercise to the petitioner.

5. Accordingly, the writ petition is disposed of.

6. Urgent certified copy of this order be granted on proper application.
