Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 05.01.2022 in connection with Phiringia P.S. Case No.04 of 2022 corresponding to C.T. Case No.1 of 2022 pending in the Court of learned Addl. District & Sessions Judge-cum- Special Judge (POCSO), Phulbani for the alleged commission of offence under Sections 363/366/343/376(2)(n) of IPC.

Considering the nature of allegations and the statement of the victim recorded under Section 164 Cr.P.C., I am not inclined to allow the prayer for bail, which is therefore, rejected.

BLAPL is accordingly rejected.

However, it shall be open to the petitioner to renew his prayer for bail after examination of the victim during trial. (Sashikanta Mishra) Judge A.K. Rana
