None appears for the Petitioner at the time of call. 3.

The Petitioner in this CMP seeks to assail the order dated 4th April, 2022 (Annexure-2) passed by learned Civil Judge (Senior Division), 1st Court, Cuttack in Civil Suit No. 398 of 2006, whereby marking the F.I.R. as 'X', learned trial Court granted liberty to learned counsel for the Plaintiff (Petitioner herein) to make submission with regard to said F.I.R. at the time of argument.

Since none appears to pursue the matter, this Court feels that the Petitioner has lost interest in pursuing the matter. 5.

Accordingly, the CMP is dismissed for non-prosecution. 6.

The interim order dated 12th May, 2022 passed in I.A. No.481 of 2022 stands vacated.

Registry is directed to intimate this order to learned trial Court immediately.
