This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.125 of 2021, on the files of Nyayadhikari-cum-J.M.F.C. Bhograi, arising out of Bhograi P.S. Case No.264 of 2021, under Sections 279/337/338/304 of IPC and is in custody since 30.12.2021.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Balasore, by order dated 09.05.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account that the charge sheet has already been filed as revealed from the order of rejection inter alia under Section 304 of IPC and keeping in view that the petitioner is in custody since 30.12.2022, this Court directs the petitioner to be released on
bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
