This matter is taken up through hybrid arrangement (virtual/physical mode).

This is an application seeking modification of the condition imposed upon the petitioner for his release on bail in terms of order dated 06.01.2021 passed by this Court in BLAPL No.3818 of 2020 as regards the appearance of the Petitioner before the "IIC, Phiringia Police Station" instead of "IIC, Patnagarh Police Station" 3.

Learned counsel for the Petitioner submits that having been released from custody, the Petitioner till now has been abiding by the said condition as to his appearance before the I.I.C., Phiringia Police Station. He further submits that the distance between the place of residence of the Petitioner and that police station being 300 kilometers, the Petitioner is facing great hardship in complying the said condition as it adversely affects his livelihood and thereby the sufferings not only goes to him but also his family.

Learned counsel for the State submits that in the facts and circumstances of the case; this Court has rightly imposed said condition.

Considering the submission made and on going through the averments taken in the petition, it is directed that instead of appearing before the I.I.C., Phiringia Police Station, the Petitioner shall appear before the I.I.C., Patnagarh Police Station every Monday in between 10.00 A.M. to 3.00 P.M. till conclusion of trial. 6.

The I.A. is accordingly disposed of.
