This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This Interlocutory Application has been filed seeking modification of order dated 17.10. 2022.

Heard learned counsel for the parties.

It is submitted by the learned counsel for the Petitioners that at the time of commission of offence Petitioner No.2 was a juvenile. Therefore, direction be issued to Petitioner No.2 to surrender before the Principal Magistrate, Juvenile Justice Board, Khurda. It is also submitted by the learned counsel for the Petitioners that co-accused, Petitioner No.1 has already been released on bail. 5.

As such the direction issued by this Court vide order dated 17.10.2022 can only be carried out by the aforesaid Court. 6.

In such view of the matter Paragraph-8 of the order dated 17.10.2022 stands modified to the effect that in place of "S.D.J.M." appearing in 2nd line of Paragraph-8 "Principal Magistrate, Juvenile Justice Board" be indicated so far as the Petitioner No.2 is concerned.
