This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is seeking pre-arrest bail in connection with Thelkoli P.S. Case No. 64 of 2022 corresponding to C.T. Case No. 872 of 2022, pending on the file of the learned SDJM, Sambalpur for commission of offence under Sections 379/411/34 of the I.P.C. read with Section 21 of MMDR Act. 4.

Taking into account the nature of the allegations, this Court directs that on surrendering within three weeks hence and moving for bail, petitioner shall be released on bail by the learned court in seisin over the matter on such terms and conditions as deemed just and proper.

It is submitted by the learned Counsel for the petitioner that the petitioner has no criminal proclivity. While enlarging the petitioner on bail, the learned Court below shall verify such assertion. If it comes to the fore that the petitioner has any

criminal antecedents, this order shall stand recalled automatically without any further reference to this Court.

Accordingly, the ABLAPL stands disposed of.
