Heard Mr. S.K. Dalai, learned counsel for the petitioner and Mr. T. Pattnaik, learned Additional Standing Counsel. 3.

The petitioner has filed this writ petition seeking direction to the opposite party no.4-Superintending Engineer, Rural Works, Kendrapara to consider the grievance of the petitioner vide Annexure-7 series for closure of the contract and to release the Bank Guarantee on account of Additional Performance Security (APS) as per Annexure-5.

In course of hearing, learned counsel for the petitioner states that the petitioner has already made representation before the opposite party no.4-Superintending Engineer, Rural Works, Kendrapara vide Annexure-7 series, and the same may be directed to be disposed of within a stipulated time, to which learned State Counsel has no objection.

As agreed by learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes

of the writ petition directing opposite party no.4 to consider the Arun/Puspa representation filed by the petitioner vide Annexure-7 series and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy this order.
