This matter is taken up through Video Conferencing Mode.

This is an application for modification of the condition imposed by order dated 29.11.2022 passed by this Court in ABLAPL No. 5596 of 2022 while directing the Petitioner to be released on bail in the event of his arrest as regards deposit of cash of Rs.35,000/-.

Upon hearing learned Counsel for the Petitioner and the learned Counsel for the State as well as learned Counsel for the Victim and on going through the averments taken in the Petition as also the order dated 29.11.2022 passed in ABLAPL No.5596 of 2022, the condition imposed is modified to the extent that the Petitioner without prejudice to his defence would deposit a sum of Rs.17,50,000/- (Rupees Seventeen Lakh Fifty Thousand) before the said Court which shall be kept under long term fixed deposit in any Nationalized Bank and would be renewed from time to time as the Court deems proper; whose disbursement / release shall be subject to the final order as would be passed at the
// 2 // conclusion of the trial; and he shall also furnish property security to the tune of Rs.17,50,000/- (Rupees Seventeen Lakh Fifty Thousand) for his release on bail upon his surrender. It is however needless to say that the Court below while accepting the property offered as security would arrive at a satisfaction that the same are free from all encumbrance and have not been given as security in any other case(s).
In view of the above modification, the date fixed for surrender of the Petitioner before the Court in seisin of the case be extended by three weeks more with effect from today. 4.
The I.A. is accordingly disposed of.
