Heard learned counsel for Petitioner and learned counsel for the State-Opposite Parties.

The present Writ Petition has been filed with the following prayer:- "1. To admit the writ petition.
2. To direct the Opposite Parties more particularly Principal Secretary (Department of Health and Family Welfare) to fix up the pay of the petitioner in the promotional post of MPHW (Male) from 5.7.1996 (Supernumerarily created) as per order of the Government dtd.04.09.2021 and consequential verification of service in the Promotional Post, keeping in view Judgment of the learned Tribunal dtd. 16.09.2016 passed in O.A. No.3869 (C) / 2012 confirmed by the Hon'ble High Court and Supreme Court and release all consequential service and financial benefit admissible in the promotional post".

He further submits that through highlighting his grievances, the petitioner has filed a representation on 07.02.2022 at Annexure-17 to the Writ Petition, before the opposite party No.1 but till date nothing has been done
// 2 // in the matter. In such background, he prays that a direction be issued to opposite party No.1 to take a decision on the above noted petition within a specific time period. 5.
Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.1 to take a decision on the above noted petition in accordance with law and also taking into account the order passed under Annexures-13 & 14 within a period of three months from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner.
6. With the aforesaid observation and direction, the Writ Petition is disposed of.
