Prakash Kumar Samal v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
CRLMC No.1304 of 2022 Sri Prakash Kumar Samal ....
Petitioner -versusState of Odisha and another ....
Opposite Parties CORAM: JUSTICE S. PUJAHARI Order No.
ORDER
22.07.2022 02.
1.
This matter is taken up through hybrid mode.
2.
This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the F.I.R. in Bonai P.S. Case No.14 of 2021, corresponding to G.R. Case No.61 of 2021, pending in the Court of S.D.J.M., Bonai. 3.
Heard the learned counsel for the Petitioner and the learned counsel for the State-Opposite Party No.1. 4.
It appears that final form has been submitted under Sections 376(2)(n), 417, 341 and 506 of the I.P.C. against the Petitioner.
// 2 // 5.
However, the learned counsel for the Petitioner submits that since the matter has been compromised between the parties and the Opposite Party No.2-Victim in her affidavit has stated that the allegation made against the Petitioner is false, the aforesaid F.I.R. be quashed.
6.
After hearing the learned counsel for the Petitioner and the learned counsel for the State-Opposite Party No.1, I am of the view that such a prayer in a case under Section 376(2)(n) of I.P.C. on the ground stated is misconceived.
7.
Accordingly, the CRLMC stands dismissed.
