The Petitioner in this writ petition seeks to assail the order dated 5th May, 2022 (Annexure-4) passed by learned Judge, Family Court, Bhubaneswar in C.P. No. 726 of 2016, whereby while rejecting an application for adjournment filed by the Petitioner, he closed her evidence and posted the matter to 19th May, 2022 for argument.

In course of hearing, Mr. Samantaray, learned counsel for the Petitioner submits that the Petitioner has already filed an application for recall of the order dated 5th May, 2022 under Annexure-4, which is pending for consideration. He apprehends that learned Judge, Family Court, Bhubaneswar without considering such application may proceed with the argument of C.P. No.726 of 2016 and in that event, the Petitioner will be highly prejudiced. 4.
Taking into consideration the submission made by learned counsel for the Petitioner, this Court disposes of this writ petition with a direction that learned Judge, Family Court, Bhubaneswar before proceeding to hear the argument in C.P. No. 726 of 2016,
// 2 // shall consider the application, if any, filed by the Petitioner (Respondent in the said C.P.) for recall of the order dated 5th May, 2022.
Urgent certified copy of this order be granted on proper application.
