Heard learned counsel for the petitioner and learned counsel for the State.

As it appears from order of this Court dated 12th August, 2022 that the matter was adjourned to 26th August, 2022 on behalf of the petitioner on the ground that the file was not traceable. On the previous date i.e. 29th July, 2022, the petitioner had also sought for an adjournment for taking instruction. However today, the learned counsel for the petitioner again prays for an adjournment to which the Court is not inclined to allow the same. 3.

Having regard to the fact that the matter is of the year 2015 and petitioner has challenged the proceeding in D.V. Act, the Court is of the view that the matter must have become infructuous by passage of time.
