This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with Kesinga P.S. G.D. Case No. 9 of 2021 corresponding to C.T. Case No. 69 of 2021, pending on the file of the learned Sessions & Special Judge, Kalahandi, Bhawanipatna, for commission of the alleged offence under Sections 20(b)(ii)(c) of the NDPS Act. 3.

Keeping in view the allegations which clearly established the conscious exclusive possession of the petitioner and the contraband beyond the permissible limit was seized from the vehicle in which the petitioner was travelling, this Court is not inclined to entertain this bail application at this stage. 4.

Accordingly, the BLAPL stands rejected.

Since the petitioner is stated to be in custody since 26.10.2021, this Court directs the learned court in seisin over the

matter to expedite the trial and conclude the same within a period of four months from the date of receipt/production of certified copy of this order. In the even trial is not concluded within the time stipulation, it shall be open to the petitioner to move the court in seisin over the matter and the same shall be considered on its own merit.
