CRLMP No.926 of 2022 Gobinda Chandra Bahinipati @ Gobinda Panda ....
Petitioner Mr. P.K. Pattanayak, Advocate -versusSuperintendent of Police, Nayagarh & others ....
Opp. Parties Mr. D.K. Mohanty, Additional Standing Counsel
CORAM:
JUSTICE BISWAJIT MOHANTY Order No.
ORDER
20.05.2022 01.
1.
Heard Mr. Pattnayak, learned counsel for the petitioner and Mr. D.K. Mohanty, learned Additional Standing Counsel. 2.
The petitioner, who is an accused and on bail has filed this case with a prayer to the opposite party Nos. 1 & 2 to submit final form, case diary, seizure list, medical report and supervision report before the learned J.M.F.C., Bhapur within a stipulated time period in connection with G.R. Case No.224 of 2019 arising out of Fategarh P.S. Case No.181 dated 20.10.2019 registered for commission of offences under Sections 302/34, I.P.C.. Though a somewhat similar prayer has been rejected by the learned J.M.F.C. on 3.3.32022, the same remains unchallenged. When queried, Mr. Pattnayak, learned counsel for the petitioner is not able to say in what manner, the petitioner has been prejudiced on account of non-submission of the above documents before the
// 2 // jurisdictional court. In such background, this Court is not willing to entertain this petition and accordingly, the CRLMP is dismissed.
