This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioners and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

Learned counsel for the petitioners submits that the petitioners have been destroyed the household articles of the informant and took away valuable articles and assaulted wife of the informant. Further, he submits that due to village dispute, the petitioners have been falsely implicated in this case.

Considering the nature of allegation, gravity of offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioners. However, it is directed that in the event the petitioners surrender before the learned S.D.J.M., Banki in G.R. Case No.172 of 2022, arising out of Baideswar P.S. Case No.64 of 2022 within a period
// 2 // of three weeks from today, they shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper including one condition whereby the petitioners shall not threaten, terrorize the informant her family members in any manner whatsoever, 6.
Accordingly, the ABLAPL is disposed of.
Urgent certified copy of this order be granted on proper application.
