This matter is taken up through video conferencing mode.
Heard the learned counsel for the petitioner and the learned counsel for the State.
This is an application for bail under section 439 of Cr.P.C. in connection with Baipariguda P.S. Case No. 70 of 2020 corresponding to T.R. Case No. 22 of 2020 pending in the Court of learned Sessions Judge - cum- Special Judge, Koraput, Jeypore for alleged commission of offence under section 20(b)(ii)(C) of the N.D.P.S. Act.
The prayer for bail of the petitioner has been rejected by the learned Special Judge, Koraput, Jeypore by order dated 13.11.2021.
Learned counsel for the petitioner submits that
// 2 // the petitioner is in judicial custody since 20.05.2020, there is no such progress in the trial so far and therefore, direction may be issued to the learned trial Court to expedite the trial and conclude the same within a specified period.
Learned counsel for the State has no objection. Considering the submissions made by the learned counsel for the respective parties, nature of accusation, quantity of ganja seized and in view of. the bar under section 37 of the N.D.P.S. Act, while not inclining to release the petitioner on bail, I direct the learned trial Court to conclude the same within a period of six months from the date of receipt of a copy of the order. The petitioner is at liberty to renew his prayer for bail is the trial is not concluded within the said period.
The BLAPL is accordingly disposed of.
