1. The matter was adjourned on 14th October, 2022 to enable the State counsel to inform whether sanction had been accorded. Even today, the instructions have not been forthcoming.

2. The Court is left with the impression that the State Government is not interested in according sanction for prosecution of the Petitioner. Admittedly, the cognizance was taken of the offences against the Petitioner, who was government servant at the relevant time without sanction having been obtained.

3. On that short ground, the impugned order dated 25th October, 2005 of the JMFC, Dhamnagar in G.R. Case No.1231 of 2005 and all proceedings consequent thereto are hereby quashed.

4. The CRLMC is disposed of in the above terms. The interim order passed earlier stands vacated.

5. A copy of this order be communicated to the concerned Subordinate Court forthwith.
