This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioners and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

Learned counsel for the petitioners submits that while the informant was sitting in his shop at that the petitioner no.1 and other two persons came to his shop and demanded money and threw chair to his head and also assaulted to the father of the informant. 5.

Considering the nature of allegation, gravity of offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioners. However, it is directed that in the event the petitioners surrender before the learned S.D.J.M., Bargarh in C.T. Case No.513 of 2022, arising out of Bargarh P.S. Case No.233 of 2022 within a period

// 2 // of three weeks from today, they shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper including the condition that the petitioners shall not threaten, terrorize the informant and his family members in any manner whatsoever. If any information received with regard to violence of the condition, they shall be taken into custody without any delay. 6.

Accordingly, the ABLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
