This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 439 of Cr.P.C. in connection with R. Udayagiri P.S. Case No. 48 of 2020 corresponding to G.R. Case No.24 of 2020 pending in the Court of learned Addl. Sessions Judge - cum- Special Judge, Paralakhemundi, Gajapati for offences punishable under sections 363/366/354-A/ 354-B/323/307/506/376(3) of the Indian Penal Code and sections 4/8 of the POCSO Act.
The petitioner moved an application for bail before the Court of learned Addl. Sessions Judge -cum- Special Judge, Paralakhemundi, Gajapati, which
// 2 // was rejected on 08.03.2022.
Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 04.07.2020 and the trial is at the stage of examination of the I.O. and therefore, direction may be given to the learned trial Court to conclude the trial at the earliest.
In view of the limited nature of prayer and taking into account the period of detention of the petitioner in judicial custody, while not inclining to release the petitioner on bail, direction is given to the learned trial Court to conclude the trial within a period of two months of recording of the accused statement. The BLAPL stands disposed of accordingly.
The order be communicated to the learned trial Court forthwith for compliance.
