This matter is taken up through Hybrid mode.

Petitioner in this writ petition prays for a direction to learned Judge, Family Court, Kendrapara for early disposal of CP No.956 of 2014 pending before him.

Taking into consideration the submission made by learned counsel for the Petitioner, this Court by order dated 6th July, 2022 directed the learned counsel to take instruction with regard to up-to-date status of CP No.956 of 2014. 4.

Mr. A. Bhuyan, learned counsel for the Petitioner produces copy of the order dated 17th May, 2022 passed by learned Judge, Family Court, Kendrapara stating that the case is next posted to 28th July, 2022. On perusal of said order sheet, it appears that on 17th May, 2022, the Petitioner sought for an adjournment. The Opposite Party No.1 also filed an application praying to dismiss the civil proceeding due to non-payment of arrear maintenance. The matter is therefore adjourned to 28th July, 2022 for filing of objection to the petition filed by Opposite Party No.1.

Learned counsel for the Petitioner does not have any instruction as to whether the Petitioner has any arrear maintenance amount to be paid to the Opposite Parties. 6.

In view of the above, direction for early disposal of CP No.956 of 2014 cannot be issued at this stage. 7.

Accordingly, the writ petition is disposed of with an observation that the parties should cooperate with learned Judge, Family Court, Kendrapara and arrear maintenance, if any, should be paid to the Opposite Parties forthwith. Issue urgent certified copy of the order on proper application.
