11.11.2022 This matter is taken up through Hybrid arrangement 03.

(video conferencing/physical mode).

Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with Special G.R. Case No.11 of 2020 arising out of Saroda P.S. Case No.65 of 2020 pending in the Court of learned Addl.

Sessions Judge -cumSpecial Judge, Bhanjanagar for offences punishable under sections 20(b)(ii)(C) and 29 of the N.D.P.S. Act.

The prayer for bail of the petitioner was rejected by the learned Special Judge, Bhanjanagar vide order dated 30.03.2022.

In view of availability of one criminal antecedent against the petitioner that too under the N.D.P.S. Act, I am not

// 2 // inclined to release the petitioner on bail. Accordingly, the prayer for bail stands rejected. The learned trial shall do well to conclude the trial within a period of six months from the date of framing of charge. The petitioner is at liberty to renew his prayer for bail if the trial is not concluded within the aforesaid period.

The BLAPL is accordingly disposed of.

A copy of the order be communicated to the learned trial Court for compliance.
