There is serious allegation involving notice at Annexure-1 that without involving the petitioners in any encroachment proceeding and in absence of any order of the competent authority, there has been straightway service of notice under Anenxure-1. This Court taking serious cognizance of such allegation, disposes of the writ petition observing that in the event the petitioners are not already involved in any encroachment case, there cannot be any eviction without following due process of law.
