This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioners and the learned Additional Standing Counsel. Perused the records. 3.

This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

Learned counsel for the Petitioners does not want to press this application, which is accordingly the ABLAPL is disposed of as not pressed in respect of Petitioner No.1.

Learned counsel for the Petitioner Nos.2 & 3 submits that the Petitioner Nos.2 & 3 are old aged persons and out of grudge, the informant has entangled both the Petitioners. 6.

Considering the nature of allegations made, gravity of the offence and the fact of the case, I am not inclined to grant anticipatory bail to the Petitioner Nos.2 & 3. However, it is directed that in the event the Petitioner Nos.2 & 3 surrender before the

// 2 // learned J.M.F.C., Sohella in G.R.Case No.262 of 2022 arising out of Bijepur P.S.Case No.99 of 2022 within a period of three weeks from today and move for bail, they shall be released on bail on such terms and conditions as the learned magistrate may deem just and proper. 6.

The ABLAPL is accordingly disposed of.
