This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.580 of 2022, on the files of learned S.D.J.M. Puri, arising out of Puri Town P.S. Case No.90 of 2022, under Sections 302/120-B/34 of IPC read with Section 25 and 27 of the Arms Act and is in custody since 21.03.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Puri, by order dated 09.05.2022 in the aforementioned case, the present BLAPL has been filed.

It is stated at the Bar that the charge sheet has been submitted on 17.07.2022.

Learned Court below had considered the bail application during the ongoing investigation. Hence, this Court is not inclined to entertain this bail application at this stage. Thus, the same stands rejected giving liberty to the petitioner to move the Court below afresh and needless to say that the application if so moved shall be considered on its own merits.

Accordingly, the BLAPL stands disposed of.
