This matter is taken up through Hybrid mode.

This petition has been filed by the Petitioner to transfer C.P No.31 of 2017 from the court of learned Civil Judge (Senior Division), Jharsuguda to the court of Judge, Family Court, Khurda now circuit court functioning at Banpur on the ground of long distance.

Heard learned counsel for the Petitioner. None appears for the Opposite Party.

It is stated by the learned counsel for the Petitioner that the Opposite Party-husband has filed a petition under Section 13-B of the Hindu Marriage Act for decree of divorce in the court of learned Civil Judge (Senior Division), Jharsuguda and since the Petitioner-wife is staying at her parental home at Khurda, it is not possible on her part to attend the Court at

// 2 // Jharsuguda. As such, she has prayed to transfer the said petition to Khurda.

Considering the facts and the submissions made, this Court is not inclined to transfer the aforesaid case to the court of Judge, Family Court at Khurda, but directs that C.P No.31 of 2017 pending on the file of the learned Civil Judge (Senior Division), Jharsuguda to the court of Judge, Family Court, Angul. Both the Courts shall do the needful on production of the certified copy of this order and intimate the same to the Opposite Party.

However, the Opposite Party is at liberty to seek review of this order, if he is aggrieved by this order in any manner. 7.

With the aforesaid order, this TRP(C) stands disposed of.

Urgent certified copy of this order be granted on proper application.
