Heard learned counsel for the parties.

For the petitioner having pleading also complaining an allegation against the family members such as opposite party nos. 6 to 18 except opposite party nos. 8, 9, 10, 15, 16 and 17 and thus there lies a proceeding to be taken care of under the provision of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. This Court again finds the representation of the petitioner in the present form won't do. It is at this stage, considering the objection of Mr.Sahoo, learned Additional Standing Counsel and going through the petition pending before the Collector of the District, the competent authority vide Annexure-4, this Court nowhere finds there is allegation against the family members. Application appears to be very casual without bringing home a case to be considered under the Act, 2007. The representation involved bald complain.

It is at this stage of the matter, Mr.Mohanty, learned counsel appearing for the petitioner sought permission for withdrawal of the writ petition with liberty to the petitioner to avail the scope of better representation before the competent authority under the Act confining to

// 2 // harassment by family members of the Senior Citizen. Consequently, the writ petition stands dismissed as withdrawn but however with liberty as prayed for.
