This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner and the learned Additional Standing Counsel. Perused the records. 3.
This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

Learned counsel for the Petitioner submits that the principal accused namely, Ashish Kumar Pattnaik has been arrested and released on bail. It is also submitted by the learned counsel for the Petitioners that the Petitioners have no role to play in the present crime and they have not assaulted the injured. 5.
On the other hand, learned Additional Standing Counsel submits that the injury report submitted, reveals that the injuries are simple in nature and the injured has been forwarded to the S.C.B.Medical College & Hospital, Cuttack for further treatment. 6.
Considering the nature of allegations made, gravity of the
// 2 // offence and the fact of the case, I am not inclined to grant anticipatory bail to the Petitioners. However, it is directed that in the event the Petitioners surrender before the learned J.M.F.C., Chhendipada in G.R. Case No.338 of 2022 arising out of Industrial P.S. (NISA) Case No.71 of 2022 and move for bail within a period of three weeks from today, they shall be released on bail on such terms and conditions as the learned magistrate may deem just and proper.
