Heard Mr. G.R. Sethi, learned counsel for the petitioner. 3.

The petitioner has filed this writ petition assailing the order dated 11.11.2010 passed by the State Administrative Tribunal, Bhubaneswar in O.A. No. 1229 of 2009 under Annexure-12, by which the tribunal has quashed the order dated 20.08.2009 and remitted the matter back to the State Government to reconsider it afresh keeping in view the provisions envisaged in the office memorandum dated 04.07.1995 within a period of four weeks. 4.

As such, the petitioner could not and should not have approached this Court by filing the present writ petition assailing the order passed by the tribunal. In any case, this Court does not find any error apparent on the face of record so as to interfere with the order impugned. More so, in the meantime, final order has already been passed in compliance of the order passed by the tribunal, for which learned counsel for the petitioner wants to amend the writ petition. But, this Court is not inclined to such a prayer.

In the above view of the matter, this Court is not inclined to

entertain this writ petition. However, liberty is granted to the petitioner to pursue his remedy before the appropriate forum in accordance with law.
