This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner and the learned Additional Standing Counsel. Perused the records. 3.

This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

Learned counsel for the Petitioner submits that the present case is mainly due to the civil dispute between the parties and this is a clear case of dispute between the parties in relation to business transactions.

Considering the nature of allegations made, gravity of the offence and the fact of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before the learned J.M.F.C., Basudevpur in G.R.Case No.425 of 2022 arising out of Kasia Marine P.S.Case No.59 of 2022 and moves for bail within a period of three

// 2 // weeks from today, he shall be released on bail on such terms and conditions as the learned magistrate may deem just and proper. 6.

The ABLAPL is accordingly disposed of.
