Heard the submission of Shri Mishra, learned Senior Counsel for the Petitioners and Mr. Ghose learned AGA for the Opposite Parties.

Shri Mishra, learned Counsel for the Petitioners takes support of the judgment of this Court involving the same issue on the same point of law through W.P.(C) No. 15237 of 2013 disposed of on 08.01.2015. There is no dispute for application of this judgment to the case at hand.

In the process, this Court sets aside the impugned order at Annexure-2 passed by the Board of Revenue in Revision Case No. 60/2003 under Section 59(2) of OLR Act and restores the order of the Additional District Magistrate passed in the Revision Case No. 60/2003.

This Writ Petition thus stands allowed.
