This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner and the learned Additional Standing Counsel. Perused the records. 3.

This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

Learned counsel for the Petitioner submits that the present false F.I.R. has been lodged entangling the Petitioner. It is also submitted by the learned counsel for the Petitioner that not a single independent witness has been examined to substantiate the case. Except the solitary statement of the complainant, there is no material against the Petitioner.

Considering the nature of allegations made, gravity of the offence and the fact of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before the learned S.D.J.M.,

// 2 // Kamakhyanagar in G.R.Case No.303 of 2022 arising out of Kamakhyanagar P.S.Case No.164 of 2022 and moves for bail within a period of three weeks from today, he shall be released on bail on such terms and conditions as the learned magistrate may deem just and proper.
