This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the entire proceeding in connection with Kumbharapada P.S. Case No.227 of 2009, corresponding to G.R. Case No.1361 of 2009, pending in the Court of S.D.J.M., Puri. 3.

No one appears on behalf of the Petitioner when the matter is called.

The defect, as pointed out by the Stamp Reporter, has not yet been removed.

In such view of the matter, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for non-prosecution. (S. Pujahari) Judge DA
