Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 14.08.2021 in connection with Harichandanpur P.S. Case No.98 of 2021 corresponding to G.R. Case No.1259 of 2021 pending in the Court of learned S.D.J.M., Keonjhar for the alleged commission of offence under Sections 342/302/201/34 of IPC.

It is alleged that the petitioner and another person assaulted the deceased thereby causing his death. As it appears except for so called confessional statement of the co-accused and the extra judicial confession of the said co-accused before his wife, there is no other acceptable material on record to show the involvement of the petitioner in the alleged occurrence.

Considering the submissions, the materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case

without fail.

BLAPL is accordingly disposed of.
