1.This matter is listed today under the heading "To be Order No.

Mentioned" and taken up through Hybrid mode.

2. The Petitioners apprehending their arrest in Khantapada P.S. Case No.121 of 2021 registered for alleged commission of offences punishable under Sections 376(3)/376(2)(n)/506 IPC and Section 3(2)(w)(i)/3(2)(v) of the S.C & S.T. (PoA) Act and Section 6 of the POCSO Act and Section 14 of the Child Labour (Prohibition and Regulation) Act, have filed this petition for their release on pre-arrest bail. 3.

Heard the learned counsel for the Petitioners and the learned counsel for the State.

4. It is submitted by the learned counsel for the State that in the supervision note, the Petitioners appear to be not involved in the aforesaid case.

5. Since there is no allegation against the Petitioners, as submitted by the learned counsel for the State, in spite of the restriction under Section 18 of the S.C. & S.T. (PoA) Act and under Section 438(4) of Cr.P.C, this Court is of the view that the Petitioners be released on pre-arrest bail.

6. Accordingly, this Court directs that in the event of arrest of the Petitioners in connection with the aforesaid case, they be released on bail by the Officer effecting arrest on such terms and conditions as deemed just and proper.

7. With the aforesaid order, this ABLAPL stands disposed of.

8. Urgent certified copy of this order be granted on proper application.
