This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Learned counsel for the Petitioner while seeking permission to withdraw the CRLMC submits that since N.B.W. was issued not in consonance with law, the Petitioner may be given liberty to surrender before the concerned Court and in that event, the Petitioner may kindly be released on bail.

Learned counsel for the State although raised objection but it was formal in nature.

Considering the above submission, the CRLMC is disposed of with a direction that if the Petitioner surrenders before the Court in seisin of the case within four weeks of receipt/production of the copy of this order and makes a motion for bail, he shall be released on bail by the learned Court in seisin of the case on such terms and conditions as deem fit and proper and in that event, the N.B.W. if any pending against the Petitioner be recalled.
