Heard Mr. A.K. Mishra, learned Addl. Govt. Advocate of the State and Mr. R. Roy, learned counsel of the opp. party. 3.

Since the order of suspension has been quashed by the Orissa Administrative Tribunal, Bhubaneswar Bench, Bhubaneswar, which is the subject matter of challenge before this Court and in the meantime proceeding has already concluded, the writ petition has become infructuous by efflux of time. Needless to say the petitioner has already retired from service one year after the order was passed by the Tribunal.

In view of the above, the writ petition stands disposed of as infructuous.
