This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Counsel for the State.

The petitioner is an accused in connection with T.R. Case No.32 of 2020 corresponding to Semiliguda P.S. Case No.55 of 2020, pending on the file of the learned Additional Sessions Judge-Cum- Special Judge, Koraput for the alleged commission of offence under Sections-20(b)(ii)(C) of the N.D.P.S Act. 4.
Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Additional Sessions JudgeCum- Special Judge, Koraput by Order dtd. 06.05.2022 in T.R. No. 32 of 2020, the present BLAPL has been filed.

Considering the submissions of the learned counsel for the petitioner, this Court is not inclined to entertain this application for bail at this stage, giving liberty to the petitioner to move afresh.

Taking into account the medical condition of the petitioner's wife as stated in the interim application, leave is granted to the petitioner to move the Court in seisin over the matter along with the Test Report in terms of the prescription of the Capital Hospital dtd. 18.07.2022 relating to test report and opinion of the Doctor thereof.

The Bail Application thus stands disposed of. 8.
