The matter is taken up by hybrid arrangement (virtual/physical) mode.

This is the second journey of the Petitioner in filing this application under Section-438 of the Cr.P.C. for his grant of bail in the event of his arrest in connection with Berhampur Town P.S. Case No.23 of 2016 corresponding to G.R. Case No.179 of 2016 on the file of learned S.D.J.M., Berhampur, for alleged commission of offence under Section-436/34 of the IPC read with Section-3 & 4 of the Explosive Substance Act, for his release on bail in the above mentioned case.

Heard learned Counsel for the Petitioner and learned Counsel for the State.

Considering the submissions made further keeping in view the earlier order dated 23.04.2018 passed in ABLAPL No. 4709 of 2017, in the absence of any change in the circumstance; is hereby dismissed the present application.

The ABLAPL is accordingly dismissed.
