This matter is taken up through hybrid mode.

None appears for the Petitioner at the time of call. 3.
This RPFAM has been filed assailing the order dated 19th September, 2015 (Annexure-5) passed by learned Judge, Family Court, Berhampur in Cr.P. No.109 of 2014.

From the order sheet, it appears that notice was directed to be issued in the order dated 23rd November, 2015 and an interim order was passed on that date. Thereafter, the matter was listed before the Registrar (Judicial) on 16th March, 2016, but none appeared on behalf of the Petitioner on that date. 5.
Although Mr. Das, learned counsel for the Opposite Party appeared without receiving notice in the matter, a copy of the RPFAM was not served on him.

In that view of the matter, this Court feels that the Petitioner has lost interest in pursuing the matter. 7.
Accordingly, this RPFAM stands dismissed for nonprosecution.

The interim order dated 23rd November, 2015 passed in Misc. Case No.307 of 2015 stands vacated.
