Petitioner No.1 is stated to have raised a Home Loan for a sum of Rs.15 Lakhs in the year 2017 from the Union Bank of India, Arilo Branch, DistrictJagatsinghpur/Opposite Party No.3. Her husband i.e. Petitioner No.2 submitted his deed of guarantee to secure the loan apart from the house itself mortgaged as a primary security.

Due to non-deposit of the due instalments, recovery process under the SARFAESI Act, 2002 was initiated.

By filing the present Writ Petition, challenge has been laid to the Sale Notice dated 16th April, 2022 fixing the auction sale of the mortgaged residential house on 20th May, 2022 for recovery of

// 2 // outstanding liabilities to the tune of around Rs.15 Lakhs.

At the time of hearing, learned counsel for the petitioner prays for permission to withdraw the present Writ Petition in view of the auction fixed for the said date having failed for want of any intending bidders.

In view of the above, the present Writ Petition stands dismissed as withdrawn.
