This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Name of learned counsel Mr. P.S. Nayak and associates be deleted since Mr. R.R. Bhattacharya and associates have entered appearance and filed Vakalatnama on 05.08.2022. Registry is called upon to trace the Vakalatnama and tag with the file. Name of Mr. Bhattacharya be reflected in the file as well as in the cause list. 4.

The petitioner is an accused in C.T. Case No.357 of 2022, on the files of S.D.J.M., Jajpur, arising out of Jajpur P.S. Case No.57 of 2022, under Sections 498-A/302/304-B/34 of IPC read with Section 4 of the DP Act and is in custody since 18.02.2022. 5.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned District and Session Judge, Jajpur,

by order dated 19.04.2022 in the aforementioned case, the present BLAPL has been filed.

It is stated tht though the FIR was registered inter alia under Section 302 of IPC, after investigation charge sheet has been submitted under Section 306 of IPC.

Taking into account the statement of the complainant who is none other than the father of the deceased and the Post-mortem report, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
