2. Heard learned counsel for the Petitioner.

The petitioner has filed this writ petition with the following prayer:- "Direct the Opp. Parties to sanction pension and pensionary benefits including Gratuity and unutilized leave salary in favour of the petitioner under the Orissa Civil Services (Pension) Rules, 1992 on the basis of his regular service as Amin from 31.12.1999 as has been decided vide order dt.11.11.2002 in O.A. No. 17(B)/2000 and his entire service period from 01.08.1982 till 31.12.1999 may be treated as qualifying service for computing the pensionary benefits in the light of the decision held by the Hon'ble Supreme Court vide judgment dt.

26.08.2020 in Civil Appeal No. 3984 of 2010;

V. Sukumaran vrs. State of Kerala and others and the decision of Punjab and Haryana High Court in Harbans Lal V. The State of Punjab and others (CWP No. 2371 of 2010, decided on 31.08.2010) which has been upheld by the Hon'ble Apex Court in SLP(c) No. 23578 of 2012 (SLP(C)..CC No.

17901 of 2011) disposed of on 30.07.2012 (State of Punjab and others vrs. Harbans Lal) and also in the case of Jeewan Lata V. State of Punjab and others, CWP No. 10238 of 2017 (O&M) decided on 10.05.2019 with all consequential benefits. "

The Petitioner has moved before Opposite Party No.1 seeking redressal of his grievances as made in the representation under Annexure-9 to the Writ Petition.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs Opposite Party No.1 to take a decision on the above noted representation of the petitioner in accordance with law, within a period of three months from the date of receipt of certified copy of this order and communicate the result thereof to the Petitioner.

With the aforesaid observation and direction the Writ Petition is disposed of.
