Mr. Parida, learned advocate appears on behalf of petitioner and submits, his client's Employee Compensation Case no.406-D of 2015 is languishing in the Court of Deputy Labour Commissioner, Cuttack. He draws attention to order dated 26th September, 2019 to submit, issues were settled and the case was directed to be put up on 23rd October, 2019. He then draws attention to paragraph 9 in the writ petition reproduced below.

"That it is pertinent to mention here that though the learned Adjudicating Authority in its order dt.26.09.2019 (Vide Annexure-3) specifically mentioned that next date is fixed to 23.10.2019 for hearing, but after proper verification of record my client informed that thereafter no date has been fixed and no hearing has been done by the adjudicating authority."

Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of opposite party no.1.

Court does not see necessity of directing issuance of notice on opposite party no.2. Instead opposite party no.1 is directed to expeditiously deal with and dispose of said Employee Compensation Case no.406-D of 2015. It is expected that the adjudication will be concluded by 4 months from date.

The writ petition is disposed of.
