1. The present petition filed by the Management challenges an Award dated 18th January, 2011 passed by the Central Government Industrial Tribunal-cum-Labour Court, Bhubaneswar (CGIT) in Transfer I.D. Case No.96 of 2001.
2. The dispute referred to the CGIT concerns the claim by the Opposite Party-Workman for regularization of his service with the Management. While rejecting the plea of the Workman, the CGIT nevertheless awarded a sum of Rs.50,000/- as compensation.
3. While issuing notice in the present petition on 2nd November, 2011, this Court stayed the operation of the impugned Award. The Workman has not appeared despite service of notice. The Unit itself has closed down and there is no question of any plea for the regularization of his services therein being considered. As far as the direction for payment of Rs.50,000/- is concerned, Mr. Narendra
Kishore Mishra, learned Senior Counsel appearing for the Petitioner-Management very frankly states that no enforcement proceedings has been initiated by the workman till date.
4. In that view of the matter, the Court does not consider it necessary to interfere with the impugned Award. The petition is disposed of accordingly.
