This is a matter involving rehearing the exercise undertaken by virtue of the Division Bench order. In commencement of rehearing, it has been brought to the notice by way of affidavit that there has been death of Opposite Party No.1. Even through learned counsel for the Petitioner submits that there is existence of legal heirs of Opposite Party No.1, there is resistance by learned counsel for the Opposite Parties. Learned counsel for the Petitioner wants to take instruction. 2.
